TERMS OF USAGE APPLICABLE FOR ALL INTERFACES OF CHIHILI (MOBILE APPLICATIONS, DIGITAL MEDIUMS, SOCIAL WEBSITES AND APPLICATIONS, CHIHILI AND OTHER COMPANY OWNED WEBSITES)
CHIHILI is an online and offline hybrid model for servicing customers for their custom stitched costumes and fashion wear. The details of the products, services or product specifications (weight, stitching seam strength, colours and tints, handwork details, sizes and measurements, etc.) as mentioned on CHIHILI digital / online mediums (All company owned and related Mobile applications, Digital Online Websites and Company owned social mediums - hereby collectively referred to as CHIHILI Interfaces') and offline fulfilment centres are only approximate values as they are custom fit measurements and may differ based on fabric quality and specifications.
Use of the Site is available only to persons who can legally enter into contracts under applicable laws. Persons who are "incompetent to contract", within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use 'Chihili (Four hooks Pvt Ltd.) Interfaces'. 'Chihili' and related entities reserve the right to terminate your access to the 'Chihili Interfaces', if it discovers that you are under the age of 18 years or suffers from any other disability, as recognized under Indian Contract Act, 1872. The jurisdiction of all disputes related to 'Cloud Tailor Interfaces' and its order / fulfilment related disputes will be Bhubaneswar, Odisha.
It is required to register with us with the required information to be able to access ‘CHIHILI Interfaces'. As a registered member, you agree to provide true, accurate, current, and complete information about yourself as prompted by the site's registration form. Registration where prohibited under any law shall be void. 'CHIHILI Interfaces' reserves the right to revoke or terminate your registration for any reason at any time, without notice.
At all times, the terms (or related or similar terms) in any communications, interfaces or related platforms:
The terms of 'Free Alterations':
1. Basic and permissible size and measurement alterations in the garments stitched by CHIHILI.
2. The decision of CHIHILI team pertaining to the possibility of any alterations in the garment is final and will be binding on the customer.
3. Style, design, or dress type changes will not be permissible under these terms at any time.
4. Change of the garment to fit another individual will not be covered under alterations.
5. All such applicable ‘alterations’ will be complimentary, only if the customer sends/walks to Chihili office in Bhubaneswar.
6. Service Charges may apply for any pickup or delivery of such alteration requirements from any place as per logistics and applicable service charges and the same will need to be paid by the customer.
7. CHIHILI will not be responsible for any refunds of any kind for any order, once a garment is altered by CHIHILI or by any other party.
8. CHIHILI will not be responsible for any financial, monetary, or other losses or issues faced by the customer, if these terms are not fulfilled by CHIHILI.
'Doorstep Measurements' would always refer to our serviceable pin codes as/if notified CHIHILI app/website from time to time. This service is provided on a 'best effort' basis and CHIHILI and its team, partners, and/or any associates may not be able to provide these services at all times due to acts of god, climate conditions, heavy workloads, and order volume or due to management decisions in the company. CHIHILI will not be responsible for any financial, monetary, or other losses or issues faced by the customer if these terms are not fulfilled by CHIHILI.
'Fashion Designer Consultation' would always mean 'web portal' based scheduled calls with Fashion designer for consultation. Fashion Designers may or may not be employees of CHIHILI and the final quality of the design or consultation outcome cannot be guaranteed by CHIHILI at any time. The service of a Fashion Designer is purely on a 'Best Effort' basis and hence any scheduled appointments or interfaces may be delayed or dropped by any CHIHILI team member/associates/partners due to various reasons, some of which may not be in company control. Chihili will not be responsible for any financial, monetary, or other losses or issues faced by the customer if these terms are not fulfilled by CHIHILI.
Other Terms and Conditions:
1. The actual stitching of the order placed, can happen at any city where CHIHILI has its partner / own operations based on the discretion of the management / operations team. The city of stitching selected on the ‘CHIHILI Interfaces’ is indicative and on ‘best effort’ basis.
2. Orders will only be placed and processed after payment of advance amount as per process notified by CHIHILI from time to time. Any changes to the said order after advance payment, will be treated as a new order and additional payments as deemed appropriate by CHIHILI.
3. Dyed fabrics and Hand Embroidery works will have a shade variation / design variation / work variance of 15% to 20% from the discussed colours or designs due to the nature of the customized works.
4. Any fitment issues pertaining to the order will need to be notified to : +91 7008013330 /CHIHILI store or partner stores / online process within 48 Hrs only as applicable.
5. Prices of services and products will vary from time to time at the sole discretion of CHIHILI.
6. Orders will only be delivered after payment of the complete due amount. CHIHILI reserves the right to retain the stitched garment in case of non-payment of dues. Alterations will be processed only after payment of the balance amount if any.
7. In case the customer doesn’t pick up the stitched garment within 10 days of the completed date, post which CHIHILI assumes no liability whatsoever for the order.
8. All customers always agree to the terms and conditions, refund policies, payment terms and other policies mentioned at www.Chihili.com at all times while placing an order. The policies and terms mentioned at www.Chihili.com will always supersede the ones mentioned here, and all customers are requested to refer to the policies and terms mentioned on www.Chihili.com at all times, in case of any queries or clarifications.
9. Customers are requested to note that the orders made / stitched by Chihili are specifically customized for them as per their unique requirements and specifications and hence refunds are not admissible for all orders.
10. Please call our customer support at +91 7008013330 for any queries related to your orders. Our process audit team will decide on the outcome of the issue analysis and the customer will be notified on the same.
11. Refunds, if any, and after due clearance as per the grievance redressal clearance process at CHIHILI through the customer support team, will only be in the form of Gift Vouchers. Such gift vouchers will have limited validity as per the terms and conditions issued from time to time. The process of issuance of Gift Vouchers usually takes 7-10 working days.
12. No cash / online refunds will be issued at any time.
13. Standard delivery timelines for normal orders are ideally 10-15 days and for complex designs it is 15-20 days. CHIHILI team will attempt to deliver the order sooner subject to the order loads and market conditions, including direct and indirect dependencies on logistics and other acts of god, which CHIHILI may not have any direct control on.
14. Due to the customized nature of orders, there may be a delay in order completion and delivery due to process / procurement delays and customers explicitly agree to these terms. We will make every effort to keep the customer notified of the order progress.
15. The actual design outcome on the final stitched garment will vary from the discussed illustration and reference images since all orders are visualized stitching processes. The customer agrees to this fact for all their orders. CHIHILI reserves the final right to decide on such scenarios.
16. CHIHILI reserves the right to change / update the applicable terms and conditions at any time without notification to others.
17. Home delivery and pickup services will be charged as per the discretion of CHIHILI.
18. Home Measurement services, if any, will be fulfilled solely at the discretion of CHIHILI based on workload and distance factors and will be charged extra on the order value.
19. There may be a difference in price of the final order due to any additional services/accessories or fabrics involved to fulfil the quality and format required. The customer will be notified of the variation in the order value. The order will be completed after confirmation of the order value from the customer.
Electronic Communications:
When you use the 'CHIHILI Interfaces' or send emails or other data, information or communicate to us, you agree and understand that you are communicating with us electronically and give your consent to receive communications electronically from us periodically, when required.
Since all the orders are custom stitched, we don't have a policy of returns for the order. We do however strive to ensure that the custom fit dress is made to the order specification to the extent possible without staff and manpower involved. For Pickup/drop order (Within the specified pin code coverage of a fulfilment centre) for an applicable order, we can carry out single time alterations to the sizes and measurements within certain limits of excess cloth and fitment possible. Customer can also call us at +91 7008013330, which remains open from Monday to Friday between 10.00AM to 4.00PM (1ST) except declared holidays. We will call you back in case of any calls missed due to high call volume.
Reviews, Feedback, Submissions:
All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to 'CHIHILI Interfaces' directly or otherwise disclosed, submitted or offered in connection with your use of this 'CHIHILI Interfaces' (collectively referred to "Comments'') will remain 'CHIHILI Interfaces' property. Such disclosure, submission or offer of any comments shall constitute an assignment to 'CHIHILI Interfaces' of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the comments, thus, it exclusively owns all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise. 'CHIHILI Interfaces' will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. 'CHIHILI Interfaces' is and shall be under no obligation (1) to maintain any Comments in confidence; or (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. You agree that any comments submitted by you to the Site will not violate this policy or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity. You further agree that no comments submitted by you to the site will be libellous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of "spam".
'CHIHILI Interfaces' does not regularly review posted comments or images share by you, but does reserve the right (but not the obligation) to monitor and edit or remove any comment submitted to the Site. You grant 'CHIHILI Interfaces' the right to use the name that you submit in connection with any of the posted comments. You agree not to use a false email address, trademark and copyright challenged content, impersonate any person or entity, or otherwise mislead as to the origin of any comments you submit. You are and shall remain solely responsible for the content of any comments (Source of Images, text, slogans and comments you make and you agree to completely indemnify 'CHIHILI Interfaces' and its affiliates for all claims resulting from any Comments you submit, we take no responsibility and assume no liability for any comments submitted by you or any third party whatsoever and at any point of time.
Accuracy of Content/ Information of Products on the 'CHIHILI Interfaces':
While 'CHIHILI Interfaces' strives to provide accurate product and pricing information, typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, 'CHIHILI Interfaces' shall have the right, on our sole discretion, to modify the type of dresses, patterns and designs and their prices of the type of products as per the region and area of servicing or information of the products or to refuse or cancel any orders placed for that product, unless the product has already been despatched. Alterations or Quality Error Request:
Please note any request for alterations or stitching quality issue will only be entertained within 7 days of receiving the order. Beyond this point no request will be taken into consideration. "spam".
COVID 19 and other emergency situations:
During COVID 19 pandemic (or any future contingencies/pandemics), Govt. of India may announce lockdown and restrictions to certain parts of country, owing to which production and Shipping of all orders will start once the lockdown opens. Your orders are safe with us and we will be working towards fulfilling them in the meantime, so keep them coming! Stay Safe. Stay Inside. The coverage of lockdowns to pin codes / zip codes in India and abroad will affect our serviceability and we request your support and continued patronage.
Use of Gift Coupons and Gift Cards/Vouchers:
Please note that we may be using the services of a third party provider for issuing Gift Coupons and Gift Cards. Hence the service availability for issuance and redemption will depend on the service parameters of such partners. Please reach out to us for any issues faced during the use of Gift cards and we will take up the matter with the service provider.
Cancellation Policy: Please note that an order cannot be cancelled if:
This is due to the nature of fabric dyes, variations in sizes due to the inherent fabric specification variations (such as stretch/variations and sag), whether at the time of manual stitching of your ordered item, dyeing and other differences in display outputs due to lighting, digital photography, colour settings and capabilities of computer monitors. 1. The fabric has been picked up for styling and stitching
2. the fabric has been sourced by us
3. cutting of the cloth / fabric for the order has been commenced
4. Any sort of work has commenced on the fabrics, which is either given by the customer or sourced by us
We recommend that you check the fabrics and the reference dresses in front of the Pickup/Delivery executive for any damages and wear and tear, before handing it over to them.
Please call us on +91 7008013330 and select the appropriate country and city and request for cancellation of the order, till such time that such feature is made available on the CHIHILI mobile phone applications or the website. Please leave us a message/SMS in case we are not able to answer the call due to high call volume. We will revert to you and update you on the status of the order at the earliest possible time. The options on the IVRS system may also change from time to time as per our company structure and processes to offer better services to our customers.
Payment for Online Orders and Shopping through 'CHIHILI Interfaces':
'CHIHILI Interfaces' offer you multiple payment methods to make your purchase by using options such as Visa, MasterCard, Diners and American Express credit/debit cards, UPI, Net banking options in India and other countries, through its selected government approved third- party payment gateways or payment processors. The availability of the services of such payment gateways in all countries is a matter of operational policy of the respective payment gateway company and 'CHIHILI' cannot be held responsible for the same.
You can be rest assured that 'CHIHILI Interfaces' trusted payment gateway partners use best possible secure encryption technology to keep your transaction details confidential at all times. We only have access to the interfaces and the related data shared by our payment gateway providers.
All payments made against the purchases/services on 'CHIHILI Interfaces' by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. In case of overseas remittances, the applicable foreign exchange rules, all applicable processing charges and regulations will apply.
Before shipping/ delivering your order to you, 'CHIHILI Interfaces' or its authorised staff / consultants / personnel may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.
Credit/Debit Card/ Net Banking Details:
You agree, understand and confirm that the Credit/Debit card/Net banking/UPI details provided by you for purchase of products on 'CHIHILI Interfaces' will be correct and accurate and you shall not use the credit/debit card/net banking which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit/debit card/ net banking details when making payment on 'CHIHILI Interfaces'. Your credit/ debit card/ net banking information never reaches 'CHIHILI Interfaces', we just get a pass, hold or fail message from our payment gateways. The said information will not be utilised and shared by our payment gateways or 'CHIHILI Interfaces' unless required for fraud verifications or by law, regulation or court order. 'CHIHILI Interfaces' will not be liable for any credit/debit card/ net banking fraud. The liability for use of a card/net banking fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.
Fraudulent /Incomplete/ Declined Transactions:
Payments for orders can be made through our Online payment methods such as UPI modes, Payment Gateway or with Cash only. We encourage all payments to be made using digital mediums. No other modes of payment are acceptable at any point of time. You undertake to remit the complete payments due to 'CHIHILI Interfaces' as per the order value agreed while confirming the order. We reserve the right to recover the cost of goods, collection charges and legal expenses from persons using the 'CHIHILI Interfaces' fraudulently/mischievously; 'CHIHILI Interfaces' reserves the right to initiate legal proceedings against such persons for fraudulent/mischievous use of the 'CHIHILI Interfaces' and any other unlawful acts or acts or omissions in breach of these terms and conditions.
We, as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly due to decline or authorization for any Transaction.
'Right to be forgotten' User Data Deletion related information:
Deleting customer identification data, whether at the expiry of an agreement or contract, or as part of a 'right to erasure' request, previously known as 'the right to be forgotten'. Under GDPR, data controllers and processors are obliged to return or delete all personal data after the end of services, or on expiry of a contract or agreement, unless it's necessary to retain the data by law.
This also includes the right to be forgotten - also known as 'right to erasure' - whereby our registered users can demand that their data is deleted if it's no longer necessary for the purpose it was collected, or there is no 'compelling' reason for its continued processing.
Our registered users can also demand that their data is erased if they've withdrawn their consent for their data to be collected, or object to the way it is being processed. The controller is responsible for telling other organisations to delete any links to copies of that data, as well as the copies themselves.
The right to erasure does not provide an absolute 'right to be forgotten '. Our registered users have a right to have personal data erased and to prevent processing in specific circumstances:
All orders placed by the customer can be cancelled, except for the following scenarios:
1. Where the personal data is no longer necessary in relation to the purpose for which it was originally collected/processed.
2. When the individual withdraws consent.
3. When the individual objects to the processing and there is no overriding legitimate interest for continuing the processing.
4. The personal data was unlawfully processed (in breach of the GDPR).
5. The personal data has to be erased in order to comply with a legal obligation.
So, if just one of these conditions applies, we will delete and remove data and recorded calls 'without undue delay', and specifically within a month, barring exceptional circumstances. Please note that such data related requirements will vary from time to time as per the law of the land and the data governing authority requirements.
